Tennessee Arrests First Mother Under Its New Pregnancy Criminalization Law


At the beginning of July, 26-year-old Mallory Loyola gave birth to a baby girl. Two days later, the state of Tennessee charged her with assault. Loyola is the first woman to be arrested under aΒ new law in TennesseeΒ that allows the state to criminally charge mothers for potentially causing harm to their fetuses by using drugs.

Does the Pregnancy Criminalization Law work?

Actually this law discourages pregnant woman to seek prenatal care. Β We don't want mothers to use drugs during pregnancy of course. Β However, many woman were originally given these drugs for legitamate medical reasons. Β The outcomes for criminalization include: 1. Not seeking Prenatal Care. 2. Poor perinatal Outcomes. 3. Diminished infant - mother attachment. Β All of these concerns worsen the outcome for the mother and the infant.Β
